1. Introduction
Welcome to HarborDriftLeaf ("we," "us," or "our"). Your use of our yacht charter services, as well as the website at harbordriftleaf.sbs (hereinafter referred to as the "Service") that is operated by HarborDriftLeaf, is subject to these Terms & Conditions ("Terms").
Agreeing to these Terms is a requirement for utilizing our Service. Should you object to any portion of these Terms, you are thereby ineligible for the Service access.
2. Service Overview
Providing luxury yacht chartering services, HarborDriftLeaf offers:
- Day-long yacht rentals
- Evening boat tours
- Corporate getaways
- Exclusive gatherings
- Extended charters
Availability and weather determine service offerings. Modifications or cessation of services may occur without prior notice.
3. Booking and Reservations
3.1 Booking Process
Charter reservations require you to:
- Have a minimum age of 18 years
- Provide truthful and thorough details
- Pay the defined deposit as elucidated in the booking acknowledgement
- Consent to these Terms & Conditions
3.2 Confirmation
Reservation confirmation is given upon payment receipt and a confirmation notice from us. Booking services may be declined at our sole discretion.
3.3 Availability
Bookings are contingent on the availability of vessels and favorable weather conditions. We strive to accommodate your preferred scheduling.
4. Payment Terms
4.1 Pricing
Pricing information is presented in € and encompasses all applicable taxes except as stated otherwise. Rates can change without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the full charter price at the time of reservation
- Full Payment: Due 48 hours leading up to the charter's departure
- Extra fees (if applicable): Due when the charter is complete
4.3 Payment Methods
We accept a variety of payment options, including major credit cards, bank transfers, and certified cheques. Secure, encrypted mechanisms take care of the payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours prior to departure: Entire refund less processing costs
- Between 24 to 72 hours before departure: 50% is refunded
- Under 24 hours before the scheduled departure: No refund will be provided
5.2 Weather Cancellations
In cases where our captain deems the weather conditions unsafe, options provided are:
- Rescheduling to an alternative available date at no extra cost
- A full refund if rescheduling is not an option
5.3 Mechanical Issues
Should there be mechanical issues with the intended vessel, efforts will be made to arrange an alternate. In case a substitute is unavailable, a full reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all crew directives
- Utilize prescribed safety gear as necessary
- Disclose any health conditions that could impact safety
- Stay within assigned sections of the yacht
6.2 Prohibited Items
Certain items are forbidden on board, including:
- Containers made of glass
- Unlawful substances
- Guns or any form of weapon
- Excessive beverages beyond accepted consumption levels
- Animals, barring pre-approved cases
6.3 Conduct
Passengers are required to behave in a respectful manner at all times. We hold the right to halt a charter without refund if behavior becomes dangerous or disrupts the journey for others involved.
7. Liability and Insurance
7.1 Our Liability
Liability is confined to the charter's payment amount. We disclaim responsibility for:
- Injuries due to a passenger’s own carelessness
- Personal possessions lost or damaged
- Secondary, consequential, or punitive losses
- Delays from weather or factors beyond our influence
7.2 Insurance Coverage
We hold comprehensive marine insurance for our vessels and operational procedures. Responsibility for travel and individual insurance lies with the passengers.
7.3 Assumption of Risk
Engagement in our charter services requires acknowledging inherent risks in nautical activities, for which you accept full responsibility for your safety and health.
8. Modifications and Itinerary Changes
We retain the authority to alter itineraries, pathways, or timings based on atmospheric conditions, safety measures, or operational needs. Efforts will be devoted to provide similar alternative arrangements.
9. Force Majeure
We are exonerated from accountability for any postponements, cancellations, or changes caused by unforeseen circumstances, inclusive of but not limited to:
- Extensive weather occurrences
- Catastrophic events
- Legal constraints
- Port discontinuations
- Vehicular malfunctions
10. Privacy and Data Protection
All personal data is managed in line with our Privacy Policy. By accessing our Service, you are agreeing to the handling of your information in the described manner within this policy.
11. Intellectual Property
The assortment of content displayed on our website, such as text, designs, logos, and imagery, is defended under copyright and trademark legislations. No unauthorized reproduction, sharing, or creation of derivative materials is permitted.
12. Governing Law
The governing laws of Monaco apply to these Terms. Legal disputes will be resolved within the courts situated in Monte Carlo, Monaco.
13. Changes to Terms
We reserve the right to adjust these Terms at will. The website will reflect these adjustments alongside the revised version's date. Continued service usage signifies acceptance of the amended terms.
